ORDERS
All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers. Please be aware that on occasions certain products that are in particularly high demand will sell out during this period. We may cancel an order if the product is not available for any reason. We will notify you if this is the case and return money received from you using the same method originally used by you to pay for the product. If you wish to cancel your order please contact our Customer Care team. No cancellation fees apply. Once an order has been dispatched it may not be cancelled and the item must instead be returned to the company according to our Returns and Exchanges Form provided by the customer care department.
CONTRACT FORMATION
Contract formation will be complete once payment for your order has been approved, we have accepted your order in the form of a confirmation email stating that we are accepting and dispatching your order, and your product has been dispatched by us.
ELIGIBILITY TO PURCHASE
To place an order with Karma Kameleon you must possess a valid credit or debit card issued by a bank acceptable to us. You will be required to provide your personal details and payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided.
PAYMENT SECURITY
All credit/debit card transactions on this site are processed using Securepay, a secure online payment gateway that encrypts your card details in a secure host environment to guarantee that no one can intercept your credit card details. The payment is protected an SSL certificate that uses industry standard 256-bit encryption technology. This is the same level of encryption used by large banks to keep your information secure.
RELATIONSHIP
Nothing in these Terms and Conditions shall create or be deemed to create any form of relationship, partnership or agency between you and Karma Kameleon. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
COMPLAINTS
We place great value on our customer satisfaction. Please let us know if you have any complaints or comments, by emailing customercare@karmakameleon.com.au, giving full details including date of purchase and order reference number where applicable and full name and contact details. We will try to resolve such disputes as soon as reasonably possible.
LIABILITY
We accept liability for death and personal injury arising from our negligence or that of our employees and agents. We do not seek to exclude our liability for fraudulent misrepresentation by us or our employees or agents. Nothing in the Terms and Conditions is intended to affect your rights under the law. If Karma Kameleon breaches the Terms and Conditions we shall only be liable for losses which are direct losses and a reasonably foreseeable consequence of such a breach. Losses are foreseeable where, for example, they could be considered by you and Karma Kameleon at the time of you placing your order, and Karma Kameleon dispatching your order.
INTELLECTUAL PROPERTY
The intellectual property rights in all software and content made available to you on or through this Site remain our property or that of our licensors and are protected by intellectual property laws and treaties around the world. All such rights are reserved by us and our licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Site nor may you use any such content in connection with any business or commercial enterprise.
INDEMNITY
You agree to indemnify, defend and hold harmless Karma Kameleon, its directors, officers, employees, consultants, agents, and affiliates from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this Website or your breach of the Terms of Service.
WAIVER
If you breach these Terms and Conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
VARIATION
Karma Kameleon reserve the right in its absolute discretion to change/terminate Terms and Conditions at any time and without notice. Karma Kameleon reserve the right to change/terminate any part of the website, any user’s access, any products provided, or the website as a whole.
PROHIBITIONS
You agree that you will be personally responsible for your use of this site and for all of your communication and activity on and pursuant to this site. If we determine that you are or have been engaged in prohibited activities, were not respectful of other users, or otherwise violated the Terms and Conditions, we may deny you access to this site on a temporary or permanent basis.
